The point value used to calculate compensation for pain

In the previous article we explained that the amount of compensation for pain and for impaired social functioning is determined by a points assessment. What exactly “one point” means, and how much an employee receives for it after a work injury or an occupational disease, is what this post sets out.

What is the points assessment actually for?

The points assessment is a way of quantifying the extent of the harm to health, both the pain and the permanent consequences. It is carried out by a doctor, usually the treating specialist or a general practitioner, in a medical report.

The number of points then determines the amount of the financial compensation the employee receives.

How much is one point worth?

Under Government Regulation No. 276/2015 Coll., on compensation for pain and for impaired social functioning caused by a work injury or an occupational disease:

The value of a point is 1 per cent of the average wage in the national economy established from Czech Statistical Office data for the first to third quarters of the calendar year preceding the calendar year in which the duty to assess the pain and the impaired social functioning arose.

The value of a point is therefore updated every year in line with the growth of the average wage in the national economy.

For 2025 the decisive average wage is CZK 45,107. The value of one point is therefore CZK 451.07.

Example:

If pain caused by a work injury in 2025 is assessed at 300 points, the employee is entitled to compensation of CZK 135,321.

This mechanism has been in place since 2023. Between 2015 and 2022 the value of one point was a flat CZK 250, and before that only CZK 120. The values of one point for the individual years are as follows:

Year of the damaging eventValue of one point
up to 2014CZK 120
2015-2022CZK 250
2023CZK 393.06
2024CZK 424.27

Where do I find out how many points I have?

The number of points has to be stated in the medical report issued by the doctor under the government regulation referred to above.

The employee has to submit that report to the employer, or to its insurer, in order to claim compensation for pain or for impaired social functioning.

What if the employer does not accept the amount?

It may happen that the employer or its insurer:

  • disputes the report,
  • accepts a lower number of points,
  • pays only part of the compensation.

In such cases we recommend not waiting and turning to specialists. Without legal help there is a risk of losing a substantial part of your claims.
